1. GENERAL

Within the scope of the contest, the prize will be drawn among the duly registered participants.

The giveaway contest offers:

  1. An immersive day at the prestigious Business Club, which is located between the 4th to 6th floors.
  2. This experience is tailored for the winner and a guest.
  3. They can enjoy the exceptional services and ambiance of the club.
  4. They can secure a spot in either the Clubroom or the Fireside Chat Room, which accommodates up to 6 individuals. This is ideal for discussions in a relaxed setting.
  5. During their visit, they will be provided with a curated assortment of beverages, including water, coffee, and soft drinks.

You will receive all details regarding redemption and the general conditions in the case of a win.

2. CONDITIONS OF PARTICIPATION

a. All persons over 18 years of age may participate in the giveaway contest. Employees of SPARK Europe or existing customers of SPARK are excluded.

Participation in the giveaway contest is only possible via LinkedIn.
The prerequisite for the draw of the prize is the active liking and commenting of the giveaway post with “New Work” on the SPARK Europe LinkedIn account.

b. The recipient of the information provided by all participants in connection with the giveaway contest is SPARK Europe. The information provided will be used solely for the purposes of the giveaway contest and for communications relating to the giveaway contest and in accordance with clause 7 of the Privacy Notice. (Name, address and email address)

c. Participation in the giveaway contest is free of charge. The chance to win and participation are independent of the purchase of goods or services. The costs incurred by the user for participation, e.g. for internet connection or mobile telephony, are to be borne by the participants themselves.

d. Participants are responsible for the accuracy of the contact details provided.

e. By entering the giveaway contest, participants accept these terms and conditions and confirm that they have read the data protection information. Each person may only enter the giveaway contest once.

f. The winner must have contacted us within 1 week (7 days) of being notified of the prize, otherwise the prize will be forfeited.

g. SPARK Europe is entitled to exclude participants from the giveaway contest without notice if they do not meet the requirements of these terms and conditions or if they manipulate or attempt to manipulate the giveaway contest, in particular the entry process, especially through multiple entries, and/or culpably violate the entry rules.

3. GIVEAWAY PRIZES AND IMPLEMENTATION OF THE GIVEAWAY

As part of the giveaway contest, one day at SPARK including half-day use of a meeting room (Fireside Chat or Clubroom) is to be won.

a. All those who have entered the prize draw will be informed if they have won.

b. SPARK Europe accepts no responsibility for the delivery of prizes to the respective winner(s). To the extent permitted by law, SPARK Europe also accepts no responsibility for the availability of the prizes.

c. The winner’s claim to the prize will also be forfeited if the prize cannot be sent correctly due to incorrect data. In the event of an undeliverable prize, another person will be drawn by lot.

d. The prize is not transferable, cannot be redeemed for vouchers and cannot be used separately.

e. The legal process is excluded.

f. Specific dates are subject to availibility at the discretion of SPARK. The voucher needs to be redeemed by 30.03.2024.

4. LIABILITY

a. Claims for damages against SPARK Europe are excluded, except in cases of intent or gross negligence. SPARK Europe as well as their respective legal representatives shall only be liable for any damage suffered by the participants insofar as the damage was caused by SPARK Europe, their legal representatives intentionally or through gross negligence. This limitation of liability does not apply to damages in the form of injury to life, body or health. Furthermore, it shall not apply in the event of a breach of material contractual obligations. In such a case, the liability of SPARK Europe shall be limited in amount and on the merits to such damages as were typical and foreseeable at the time the contract of use was concluded. An essential contractual obligation is an obligation the fulfillment of which makes the proper performance of the contract possible in the first place and on the observance of which the contractual partner may generally rely.

b. SPARK Europe cannot guarantee the availability of the offer at all times.

c. SPARK Europe cannot be held responsible in any way for loss or damage arising in connection with the giveaway contest or a transmission error or other, in particular technical difficulties (for example overloading) or loss of data.

d. By participating in the competition, participants release SPARK Europe from all claims, including claims for damages. All further rights and claims for damages of SPARK Europe remain unaffected.

5. PREMATURE TERMINATION OF THE GIVEAWAY CONTEST

a. SPARK Europe reserves the right to cancel or interrupt the giveaway contest at any time without prior notice. This applies in particular if, for technical reasons (e.g. viruses in the computer system, manipulation or errors in the hardware and/or software), for reasons of manipulation of the entry process or for legal reasons, proper implementation of the giveaway contest cannot be guaranteed.

b. Participants’ claims for performance and damages in the event of premature termination of the promotion pursuant to section 6.a. are excluded within the scope of the provisions of section 5.a..

6. MISCELLANEOUS

a. Cash payment, exchange for other non-cash assets and transfer of the prize to another person is not possible. In the unlikely event that the prize is unavailable, SPARK Europe reserves the right, at its sole discretion, to substitute it with a prize of equal or greater value.

b. These terms and conditions may be amended by SPARK Europe at any time with prior notice if it is otherwise no longer possible to ensure the proper conduct of the competition. For the same reason, the giveaway contest may also be interrupted or cancelled completely by SPARK Europe.

c. Should individual provisions of the conditions of participation be or become invalid, the validity of the remaining conditions of participation shall remain unaffected.

d. These Terms and Conditions of Participation and the legal relationship between the Participants and SPARK Europe shall be governed exclusively by German law to the exclusion of the UN Convention on Contracts for the International Sale of Goods.

7. DATA PROTECTION NOTICE

a. SPARK Europe, as the responsible body within the meaning of the BDSG1 and the DSGVO2, will always collect, process and use all personal data provided to SPARK Europe in the context of this giveaway contest in accordance with the applicable provisions of data protection law. Personal data for the purpose of carrying out the competition will be processed by SPARK Europe in accordance with Art. 6 (1) sentence 1 lit. b) DSGVO. Personal data in this sense are the following personal data provided by participants as part of the giveaway contest: Name, address and email address.

b. SPARK Europe will not disclose this personal data to third parties. This does not include the service companies based in Germany that assist SPARK Europe in carrying out this giveaway contest, which are also obliged to act in accordance with the applicable laws. The collection, processing and use of your data is solely for the purpose of conducting the giveaway contest. The data provided by the participants will not be stored or used for any other purpose.

c. The personal data of the participants will be deleted after the end of the giveaway contest, insofar as this does not conflict with any statutory retention periods, in particular with regard to compliance with tax regulations.
